Regulated Work
The Protection of Vulnerable Groups (PVG) Scheme applies to people who work with children and/or protected adults in what is referred to as ‘regulated work’. This work can be either paid or unpaid, so it includes people who work as volunteers.
The Protection of Vulnerable Groups (Scotland) Act sets out to protect vulnerable people, who are defined as:-
individuals over the age of 16 and who are provided with (and thus receive) Care, Health, Community Care or Welfare services (that is ‘protected adults’) and children under the age of 18.
For an activity (or work) to be considered ‘regulated work’, the carrying out of the activity (or work) must be part of the individual’s normal duties, that is something an individual does as part of their post on an ongoing basis.
Some work activities with children or protected adults are excluded from being considered as ‘regulated work’. This would commonly be if the activity is incidental to an employee or volunteers normal work, or if the individuals they are working with do not fall under the ‘protected’ characteristics of The Protection of Vulnerable Groups (Scotland) Act.
It will be up to your group or organisation to decide if an employee or volunteer is doing ‘regulated work’ as part of their normal duties.
If your community group or organisation has volunteers or paid staff which you consider to be doing ‘regulated work’, your committee or board has a legal responsibility to make sure that those people are suitable to work with children or vulnerable adults. This makes access to the information held on the PVG Scheme lists vital to your recruitment procedures.
