Disclosures

Disclosure records are used as part of recruitment procedures to help employers meet their legal duty of making sure that an individual is suitable to be working with children or other vulnerable people. 

Disclosure records typically contain impartial and confidential criminal history information held by the police and government departments on an individual. The details will depend on the type of disclosure applied for.

They will typically include:-

  • details of a person’s criminal records
  • information about an individual’s inclusion on the Protection of Vulnerable Groups (PVG) Scheme Children’s or Adults’ Lists (in which case that person would be barred from carrying out what is referred to as ‘regulated work’
  • other relevant information held by a local police force or Government Body
  • or they will state that there is no information held on the person

Disclosures will either be referred to as:-

  • Protection of Vulnerable Groups (PVG) Scheme Records  – if they are issued in respect of a volunteer or employee who is carrying out ‘regulated work’

OR

  • Disclosure Certificates - Basic, Standard and Enhanced disclosure certificates are still available for positions outwith the scope of the PVG scheme

Disclosure record applications submitted by enrolled organisations for volunteer positions will be processed free of charge by the Central Registered Body in Scotland (CRBS).

Disclosures available under the PVG Scheme

Within the PVG scheme there are three types of disclosure records:- 

Statement of Scheme Membership Record 

A Statement of Scheme Membership Disclosure will show that a named individual is a member of the PVG Scheme and the workforce(s) to which the membership relates.  It confirms whether the person is barred from working with children and/or protected adult and if they are under consideration for listing, but does not contain any detailed information about any convictions that person may hold.  You should request a Scheme Record not a Scheme Membership if you wish to see further information, or if an individual is not already a scheme member. 

Scheme Record 

A Scheme Record Disclosure contains a scheme membership statement and any vetting information that is held about a scheme member. The information held about a person on their PVG Scheme Record – referred to as vetting information – includes convictions held on central records in the UK; whether the individual is included in the sex offenders register; relevant non conviction information provided by police forces and prescribed civil orders. 

Vetting information is only disclosed on a Scheme Record Disclosure, but its existence and additions (or deletions) are flagged on the Scheme Record Update.  In response to a disclosure request, the content of the Scheme Record can be disclosed to scheme members and registered persons employing them in regulated work or acting for anybody employing the individual through the Scheme Record Disclosure.   

Scheme Record Update 

A Scheme Record Update Disclosure contains a summary of the information held in an individual’s scheme record, providing the scheme membership statement, the date that the last full scheme record was issued, whether it contains any vetting information, and whether any vetting information has been added to or removed from the scheme since that date. 

Other Types of Disclosures 

Basic, Standard and Enhanced disclosure certificates are still available under the 1997 Police Act for positions outwith the scope of the PVG scheme. 

Basic Disclosures 

Basic disclosures are available to anyone, they are not job specific.  These detail convictions considered to be unspent under the terms of the Rehabilitation of Offenders Act 1974.

Standard disclosures 

Standard disclosures are available for positions such as those involved with the provision of Care and Health services.  These detail both spent and unspent convictions under the terms of the Rehabilitation of Offenders Act 1974.

Enhanced disclosures 

Enhanced disclosures are available for positions such as those applying for lottery and gaming licenses, firearms licenses and Prison Officers.  Enhanced disclosures detail all information contained on a standard disclosure but may also detail non-conviction information which is relevant information held by local police.
