Public Duty

The Equality Act 2010 places a general ‘Public Duty’ on statutory organisations (including local authorities) to take action against discrimination in all areas of their work and services. 

Local Authorities are required by law to pay due regard to promoting equality of opportunity amongst people with one of the nine ‘protected characteristics’ as defined in the Equality Act 2010.

Promoting equality effectively means thinking about the design and delivery of services, as well as having implications for employment policy and practice.

Local Authorities are legally obliged to involve the Third Sector in planning their equality objectives.

How does this affect your community group?

• if you do not think that the Local Authority is complying with its legal obligations to involve the Third Sector you can hold them accountable by challenging them and contacting the Equality and Human Rights Commisson
• if your community group is contracted to deliver services by a Local Authority you will be required to demonstrate your group’s commitment to eliminating discrimination and reducing inequality.
